Welcome to AGIFEST PRIVATE LIMITED. By accessing or using the Platform, you agree to be bound by these Terms of Use, our Privacy Policy, and all other rules posted on the site.
Eligibility
Users must be 18 years or older and capable of entering into binding contracts under Indian law.
Account Responsibility
– Users must provide accurate information and maintain confidentiality of account credentials.
– Users are responsible for all activities under their account.
Use of the Platform
Users agree not to:
– Post unlawful, harmful, or objectionable content;
– Violate intellectual property rights;
– Attempt to gain unauthorized access to other accounts or systems;
– Misuse the platform for fraudulent or illegal purposes.
Indemnity
Users agree to defend, indemnify, and hold harmless AGIFEST PRIVATE LIMITED, including its directors, officers, employees, partners, affiliates, and service providers, from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
1. Users’ use of the Platform operated by AGIFEST PRIVATE LIMITED, including the creation, management, backing, or participation in any crowdfunding campaign.
2. Any content submitted or provided by Users, including but not limited to text, images, videos, audio, artwork, logos, campaign descriptions, reward materials, updates, or any other data or creative assets. This includes claims alleging that such content:
– infringes, violates, or misappropriates any copyright,
– infringes any trademark, patent, trade secret, or other intellectual property rights,
– violates moral rights, privacy rights, or publicity rights of any person or entity.
3. Any breach by Users of these Terms & Conditions, platform policies, or applicable laws.
4. Any violation by Users of the rights of another person or entity, including intellectual property, contractual, proprietary, privacy, or consumer rights.
5. Any campaign initiated or managed by Users, including but not limited to:
– failure to deliver promised rewards,
– misuse, misappropriation, or mismanagement of funds,
– fraudulent, misleading, or inaccurate representations,
– delays, defects, safety issues, or damages arising from any reward, product, or service associated with a campaign.
This indemnity obligation will survive the termination or suspension of a User’s account and the User’s continued or past use of the Platform operated by AGIFEST PRIVATE LIMITED.
Account Suspension and Termination
AGIFEST PRIVATE LIMITED reserves the right to suspend, restrict, or permanently terminate a User’s account, without prior notice, if:
1. The User breaches these Terms & Conditions, the Content Standards, or any other platform policy;
2. The User submits or shares content that is unlawful, misleading, harmful, infringing, abusive, or otherwise violates intellectual property, privacy, or third-party rights;
3. The User engages in fraudulent, deceptive, or suspicious activities, including misuse of campaign funds, misleading representations, or attempts to manipulate campaign outcomes;
4. The User’s actions pose a risk to the safety, integrity, or operation of the platform, other Users, or AGIFEST PRIVATE LIMITED;
5. AGIFEST PRIVATE LIMITED determines, at its sole discretion, that continued access to the Platform may cause legal, financial, operational, or reputational harm.
Upon suspension or termination, Users may lose access to their campaigns, rewards, funds, or platform features. AGIFEST PRIVATE LIMITED is under no obligation to reinstate any account or restore any data once an account has been restricted or terminated.
Project Sponsorship & Rewards
– Backers support projects at their own risk.
– The Platform does not guarantee project completion, success, or reward fulfillment.
Fees and Payments
– The Platform may charge service fees, which will be disclosed upfront.
– All payments are processed via third-party gateways.
Fees and Charges
AGIFEST PRIVATE LIMITED applies a standard platform fee on all successful transactions processed through the Platform. By using the Platform, Users agree to the following fee structure:
1. Platform Fee:
A fee of 10% will be charged on each successful transaction made through any crowdfunding campaign on the Platform.
2. Break-up of the 10% Fee:
– Platform Usage Fee (7%) – Covers platform maintenance, technology infrastructure, customer support, campaign tools, and operational expenses.
– Payment Gateway Fee (3%) – Covers charges applied by third-party payment service providers for processing payments, refunds, and secure transactions.
3. Net Amount to Campaign Creators:
After deducting the 10% fee, the remaining 90% of the transaction amount will be transferred to the campaign creator, subject to verification, settlement timelines, and compliance requirements.
4. Taxes:
All fees may be subject to applicable taxes (including GST), which will be added to the stated fee percentage wherever required by law.
5. Non-Refundable Fees:
All platform fees and payment processing charges are non-refundable, even if a campaign is suspended, cancelled, unsuccessful, or fails to deliver rewards.
6. Fee Updates:
AGIFEST PRIVATE LIMITED reserves the right to revise the fee structure at any time. Updated fees will be posted on the Platform and will apply to future transactions.
Payment Blocking Rights
AGIFEST PRIVATE LIMITED (“AGIF”) reserves the right, at its sole discretion, to block, hold, delay, or withhold any payment or payout associated with a User’s account or campaign if:
1. AGIF suspects fraud, misuse of funds, or deceptive activity;
2. The campaign or User is under investigation for breach of these Terms & Conditions, Content Standards, or any platform policy;
3. The campaign violates applicable laws, regulations, or third-party rights;
4. AGIF receives complaints, disputes, or credible reports regarding the campaign’s legitimacy, safety, or intended use of funds;
5. The User fails to provide required documentation, verification details, or compliance-related information;
6. AGIF determines that releasing the payment may cause financial, legal, or reputational risk to contributors, the platform, or AGIF.
Payments may remain blocked until the issue is resolved to the satisfaction of AGIFEST PRIVATE LIMITED. AGIF is not liable for any delays, losses, or consequences arising from such payment blocking actions.
No Financial Returns
Little Push and AGIFEST PRIVATE LIMITED do not provide any financial return in any form whatsoever, including
but not limited to financial securities (debt or equity), interest, dividend, profit share, rewards in cash,
or cash equivalents, to persons who contribute on Little Push. All contributions made through the platform are
voluntary and non-refundable, and are not to be treated as investments or financial products.
Intellectual Property
– Content uploaded remains the user’s property, but AGIFEST PRIVATE LIMITED is granted a non-exclusive license to use, reproduce, and display it.
– AGIFEST PRIVATE LIMITED respects intellectual property rights and may remove infringing content.
Privacy
User data is governed by our Privacy Policy, in compliance with Indian law.
Payment Data Storage and Security
Payment Data Storage and Security
AGIFEST PRIVATE LIMITED follows industry-standard security practices and regulatory requirements for the handling and storage of payment-related data. By using the Platform, Users acknowledge and agree to the following:
1. Third-Party Payment Processing
All payment transactions made on the Platform are processed exclusively through secure, authorized third-party payment gateways that are compliant with applicable laws and industry standards, including PCI-DSS (Payment Card Industry Data Security Standard).
2. No Storage of Sensitive Payment Information
AGIFEST PRIVATE LIMITED does not store or have access to sensitive payment data, including but not limited to:
– Full credit card numbers
– CVV/CVC codes
– Bank account PINs
– Net banking credentials
– UPI PINs
– OTPs (One-Time Passwords)
Such information is collected, encrypted, and processed directly by the third-party payment gateway.
3. Limited Payment Information Storage
AGIFEST PRIVATE LIMITED may store limited, non-sensitive transactional information necessary for record-keeping, settlements, compliance, and customer support, such as:
– Transaction ID
– Date and time of transaction
– Amount contributed
– Payment method (e.g., card, UPI, net banking) without revealing full card or account numbers
– Status of the payment (success, pending, failed)
This information is stored in compliance with applicable data-protection laws.
4. Encryption & Secure Storage Practices
Any payment-related data that the Platform is permitted to store is maintained using:
– Encrypted databases
– Secure servers
– Access controls and logging
– Industry-standard cybersecurity protocols
– Periodic audits to detect vulnerabilities or unauthorized access
5. Compliance With Legal Requirements
AGIFEST PRIVATE LIMITED handles payment information in accordance with:
– RBI guidelines for digital payments
– PCI-DSS standards (via payment gateway partners)
– Indian data-protection and privacy laws
– Any additional regulations that may apply from time to time
6. Restricted Access
Only authorized personnel, under strict confidentiality obligations, may access limited non-sensitive payment records solely for operational, audit, dispute resolution, or compliance purposes.
7. No Liability for Third-Party Systems
The Platform is not responsible for breaches, failures, or vulnerabilities occurring within third-party payment gateways or external systems that are outside the direct control of AGIFEST PRIVATE LIMITED.
Grievance Redressal
Users may report grievances via the procedure outlined in the Grievance Redressal Policy
Limitation of Liability
AGIFEST PRIVATE LIMITED is not liable for damages, losses, or disputes arising from user interactions or project failures.
Termination
AGIFEST PRIVATE LIMITED reserves the right to terminate or suspend user access for violations of these terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts in Mumbai, India shall have exclusive jurisdiction over disputes.
Amendments
We may modify these Terms from time to time. Continued use after changes means acceptance of new terms.
